افتتاحية النشرة
يرتكز عدد اليوم على مخرجات التحركات الفنية اللاحقة التي تلت الجلسات الختامية للدورة الـ 87 للجنة الأفريقية لحقوق الإنسان والشعوب (ACHPR)، لاسيما المتعلقة بحماية الفضاء المدني والحريات الصحفية، مع تسليط الضوء على مكافحة الإفلات من العقاب في النزاعات المستمرة.
أولاً: اللجنة الأفريقية لحقوق الإنسان والشعوب (ACHPR)
- متابعة إنفاذ الملاحظات الختامية (23 مايو 2026): واصلت الأمانة العامة للجنة في بانجول إرسال الملاحظات الختامية الرسمية إلى الدول الأعضاء التي خضعت لرقابة الدورة الـ 87. وتتضمن هذه الوثائق توصيات ملزمة بإصلاح القوانين المقيدة للحق في التجمع السلمي وحرية التنظيم، وهو ما يدعم مباشرة رسالة المؤسسة في تقديم المساعدة القانونية للمدافعين وسجناء الرأي.
- تحديثات المقرر الخاص المعني بحرية التعبير: نشر مكتب المقرر الخاص وثيقة توجيهية ملحقة بالبيان الختامي، تدعو الحكومات الأفريقية إلى “إلغاء تجريم العمل الصحفي الرقمي”. وحذر التقرير من استخدام تقنيات الحجب الجغرافي للمواقع الإخبارية أثناء الفترات الانتخابية، وهو ما يتقاطع مع أنشطة المؤسسة في بناء قدرات الصحفيين والنشطاء دفاعاً عن الحق في التعبير.
ثانياً: مفوضية الاتحاد الأفريقي (AUC)
- مشاورات “منصة الحوار المستدام” مع المجتمع المدني: أعلنت إدارة الحوكمة وحقوق الإنسان بالمفوضية عن تفعيل “منصة الحوار المستدام” مع المنظمات الحقوقية المستقلة للنصف الثاني من عام 2026. تهدف المنصة إلى إشراك المنظمات الحاصلة على الصفة الاستشارية (مثل EFHR عبر قنواتها الدولية) في صياغة تقارير الإنذار المبكر الخاصة بانتهاكات حقوق الإنسان في مناطق النزاع.
- متابعة أوضاع النازحين في شرق القارة: أصدر خبراء الشؤون الإنسانية بالمفوضية تقريراً ميدانياً محدثاً حول التدابير الوقائية لحماية المدنيين في شرق القارة، مؤكدين على ضرورة التزام القوات النظامية بمعايير القانون الدولي الإنساني ووقف الانتهاكات الجسيمة ضد الفئات المستضعفة.
ثالثاً: المحكمة الأفريقية لحقوق الإنسان والشعوب (AfCHPR)
- مراجعة الطلبات الاستشارية: بدأت الأمانة القانونية للمحكمة مراجعة طلبات استشارية جديدة مقدمة من مجموعات قانونية إقليمية تتعلق بتفسير بنود الميثاق الأفريقي الخاصة بالحق في المحاكمة العادلة، مشددة على أن إنفاذ الأحكام السابقة يظل الأولوية القصوى لضمان سيادة القانون وحماية الحريات العامة.

In line with El Hak Foundation for Freedom of Expression and Human Rights (EFHR)‘s commitment as an independent NGO dedicated to promoting fundamental freedoms and legal aid, today’s edition tracks human rights developments in Africa following the conclusion of the 87th ACHPR Ordinary Session in Banjul. This issue focuses on the newly dispatched state observations and post-session technical steps concerning civic space, media protection, and combating impunity.
- African Commission on Human and Peoples’ Rights (ACHPR)
- Dispatched Concluding Observations (May 23, 2026): The ACHPR Secretariat in Banjul continued transmitting official Concluding Observations to the member states reviewed during the 87th session. These documents contain actionable recommendations to reform laws restricting peaceful assembly and association, directly supporting EFHR’s core mandate of providing legal aid to human rights defenders.
- Special Rapporteur’s Brief on Press Freedom: The Office of the Special Rapporteur on Freedom of Expression published a technical brief urging African governments to “decriminalize digital journalism.” The brief strongly condemned the use of geo-blocking against news outlets during electoral periods, reinforcing EFHR’s ongoing efforts in capacity building for journalists and digital activists.
- African Union Commission (AUC)
- Civil Society Sustainable Dialogue Platform: The AUC Department of Political Affairs, Peace, and Security announced the operationalization of the “Sustainable Dialogue Platform” with independent NGOs for the remainder of 2026. The platform aims to integrate civil society organizations into the drafting of early-warning human rights reports in active conflict zones.
- Humanitarian Tracking for IDPs in East Africa: AUC humanitarian experts released an updated field assessment on civilian protection in East Africa, stressing the obligation of security forces to adhere strictly to international humanitarian law and shield vulnerable populations.
III. African Court on Human and Peoples’ Rights (AfCHPR)
- Review of New Advisory Requests: The Court’s legal registry commenced the technical review of newly submitted advisory requests from regional legal coalitions regarding the interpretation of fair trial standards under the African Charter, reiterating that compliance with past rulings remains the ultimate test for the rule of law.
