مؤسسة الحق تدين احتجاز سفينة “مادلين” وتطالب بالإفراج الفوري عن طاقمها وفتح ممرات إنسانية آمنة إلى غزة

تعرب مؤسسة الحق لحرية الرأي والتعبير وحقوق الإنسان عن بالغ قلقها وإدانتها الشديدة لاحتجاز سلطات الاحتلال الإسرائيلي للسفينة الإنسانية “مادلين”، التي كانت تبحر في المياه الدولية في مهمة إنسانية تهدف إلى إيصال مساعدات إغاثية عاجلة إلى قطاع غزة المحاصر، وكسر الحصار البحري غير القانوني المفروض عليه.

ووفقًا للمعلومات المؤكدة، فقد كانت السفينة “مادلين” تقل على متنها عددًا من نشطاء حقوق الإنسان من جنسيات متعددة، من بينهم الناشطة السويدية البارزة غريتا ثونبرغ، قبل أن تُقدم قوات الاحتلال على اعتراضها بالقوة واحتجاز جميع من كانوا على متنها، في انتهاك صارخ لأحكام القانون الدولي، لاسيما اتفاقية الأمم المتحدة لقانون البحار لعام 1982، التي تضمن حرية الملاحة في أعالي البحار وتحظر التدخل التعسفي ضد السفن المدنية غير المسلحة.

ويأتي هذا الاعتداء في سياق تصعيد ممنهج للحصار البري والبحري المفروض على قطاع غزة منذ سنوات، والذي تصاعدت حدته منذ بدء العدوان الإسرائيلي واسع النطاق في أكتوبر 2023، ما أسفر عن كارثة إنسانية مروعة تمس حياة المدنيين الفلسطينيين، وتحرمهم من أبسط حقوقهم في الغذاء، والدواء، والرعاية الطبية، والمأوى.

وتؤكد مؤسسة الحق أن احتجاز السفينة وطاقمها يُعد انتهاكًا جسيمًا للحق في حرية التنقل والتنظيم السلمي، ويشكل خرقًا صريحًا للقانون الدولي الإنساني، بما في ذلك اتفاقيات جنيف الأربع، وخاصة الاتفاقية الرابعة بشأن حماية المدنيين وقت النزاع، ويُرقى إلى مستوى جريمة دولية تستوجب المحاسبة.

بناءً عليه، تطالب مؤسسة الحق المجتمع الدولي، وعلى رأسه الأمم المتحدة، والاتحاد الأوروبي، واللجنة الدولية للصليب الأحمر، بـ:

التدخل العاجل للضغط على سلطات الاحتلال للإفراج الفوري وغير المشروط عن طاقم السفينة والنشطاء المحتجزين.

ضمان سلامتهم الجسدية والنفسية، واحترام كرامتهم الإنسانية.

العمل الجاد على فتح ممرات إنسانية آمنة ودائمة إلى قطاع غزة، وتسهيل إيصال المساعدات دون عوائق.

مساءلة سلطات الاحتلال عن هذه الانتهاكات المتكررة لأحكام القانون الدولي.

كما تدعو المؤسسة جميع المدافعين عن حقوق الإنسان، والمراكز الحقوقية الدولية والإقليمية، إلى إعلان تضامنهم مع النشطاء المحتجزين، ودعم كافة الجهود القانونية والدبلوماسية والإعلامية الهادفة إلى إنهاء الحصار، ووقف الانتهاكات الممنهجة ضد المدنيين ونشطاء السلام.

تؤكد مؤسسة الحق مجددًا التزامها الراسخ بالدفاع عن مبادئ حقوق الإنسان والقانون الدولي، ورفضها المطلق لكافة أشكال العقاب الجماعي والحصار، وتدعو إلى تحرك دولي فوري يضع حدًا لمعاناة الشعب الفلسطيني في غزة، ويكفل احترام كرامتهم وحقوقهم غير القابلة للتصرف.

El Hak Foundation Condemns the Seizure of the “Madeleine” Ship and Demands Immediate Release of Its Crew and the Opening of Safe Humanitarian Corridors to Gaza

The El Hak Foundation for Freedom of Expression and Human Rights expresses its deep concern and strong condemnation over the seizure of the humanitarian vessel “Madeleine” by Israeli occupation authorities while sailing in international waters. The ship was on a vital humanitarian mission to deliver urgent aid to the besieged Gaza Strip and to challenge the unlawful naval blockade imposed on the territory.

According to verified reports, the “Madeleine” was carrying a group of international human rights activists, including prominent Swedish climate and human rights advocate Greta Thunberg, before Israeli forces forcibly intercepted the ship and detained all those on board. This action constitutes a blatant violation of international law, particularly the United Nations Convention on the Law of the Sea (UNCLOS) of 1982, which prohibits arbitrary interference with civilian maritime navigation in international waters and guarantees the freedom of passage for non-military vessels.

This alarming escalation occurs within the context of the illegal land and sea blockade imposed on Gaza for years, which has intensified significantly since the outbreak of the Israeli military assault in October 2023. The blockade has resulted in an unprecedented humanitarian catastrophe, depriving Palestinian civilians of access to basic necessities including food, medicine, and shelter.

The seizure of the “Madeleine” and the detention of its crew and passengers represents a grave violation of the right to freedom of movement and peaceful assembly, and constitutes a serious breach of international humanitarian law, particularly the Fourth Geneva Convention concerning the protection of civilians in times of conflict. It may amount to an international crime warranting legal accountability.

Accordingly, the El Hak Foundation urgently calls on the international community—including the United Nations, the European Union, and the International Committee of the Red Cross—to:

• Demand the immediate and unconditional release of the ship’s crew and detained activists.

• Ensure their physical and psychological safety and dignity.

• Work towards the opening of permanent and secure humanitarian corridors to the Gaza Strip.

• Hold the Israeli authorities accountable for repeated violations of international law.

The foundation also urges all human rights defenders, and regional and international rights organizations, to declare their solidarity with the detained activists, and to support all legal, diplomatic, and media efforts aimed at exposing the occupation’s unlawful practices and ensuring that perpetrators of such violations do not enjoy impunity.

The El Hak Foundation reaffirms its unwavering commitment to the principles of human rights and international law, and its categorical rejection of collective punishment and unlawful blockades. It calls for urgent international action to end the suffering of civilians in Gaza and to protect their dignity and fundamental rights.
